Challenges in the Mozote Case / Más desafíos para la justicia en el caso de El Mozote

Judge Jorge Guzmán denounced the swearing in of the substitute judges and magistrates, which took place over the weekend and called it “unconstitutional.” The event took place despite the precautionary measures that suspended the application of the reforms issued by the assembly controlled by New Ideas, which seek to dismiss judges who have already served 30 years or are older than 60 years, as is the case of Guzman.

Guzmán, until a few months ago, had advanced the trial in the case of the El Mozote massacre, making high-rank members of the Salvadoran army hear the testimony of survivors and relatives of those who were murdered, he also confronted the provisions of the government of Nayib Bukele, who blocked his access to the military files, even though only the information related to the operation that led to the massacre was required. This operative was funded by the United States government.

 

Guzmán indicated that he intended to report to work on Monday, but his replacement took office over the weekend.
“The court (Supreme Court of Justice, CSJ) should not have appointed judges while these measures were in force (…) it is a dismissal,” he lamented, according to ‘La Prensa Gráfica’.

Guzmán has warned that it is delicate that the new judge for the El Mozote case is “subordinate” to the Executive Branch of Nayib Bukele. “There is a tendency of favoring these people, the military who are being prosecuted,” he added.

The magistrate of the Supreme Court of Justice imposed by the ruling party, Óscar López Jerez, mentioned that, after the departure of Judge Guzmán, the El Mozote case and surrounding places will start from scratch.

Jerez mentioned that the biggest problem with Judge Guzmán was that he did not think about the case, but only about himself:
“Unfortunately the judge (Jorge Guzmán) did not think much about the case, he decided not to request an availability regime”, said López Jerez.

Guzmán did not want to adapt to the only option left by the ruling party, which was to submit to the “availability regime“, because, for him, accepting that would be endorsing the legal irregularities that the government has been incurring since it took power on June 1, 2019.

With this, the case not only goes back up the last five years in which Judge Guzmán took the reins of the case and sought truth and justice in the massacre of El Mozote and surrounding places, but also 40 years of constant struggle of relatives of victims and victims of said massacre.

El juez Jorge Guzmán denunció la toma de posesión de los jueces y magistrados sustitutos, que ha tenido lugar durante el fin de semana y ha tildado de “inconstitucional”. La juramentación ha tenido lugar a pesar de las medidas cautelares que suspendían la aplicación de las reformas emitidas por la asamblea controlada por Nuevas Ideas que buscan cesar a jueces que ya llevan 30 años de servicio o son mayores de 60 años, como es el caso de Guzmán.

Guzmán, hasta hace unos meses, había hecho avanzar el juicio en el caso de la masacre de El Mozote, sentando a varios militares en el banquillo de los acusados y se enfrentó a las disposiciones del gobierno de Nayib Bukele, quien le bloqueó el acceso a los archivos militares, aún cuando únicamente se requería la información relacionada al operativo que llevó a dicha masacre, con el financiamiento del gobierno de los Estados Unidos.

Guzmán indicó que se presentaría el lunes a trabajar, pero su sustituto ha tomado posesión durante el fin de semana.

“La corte (Corte Suprema de Justicia, CSJ) no tendría que haber nombrado jueces mientras estas medidas estuvieran vigentes (…) es una destitución”, ha lamentado, según ha recogido ‘La Prensa Gráfica’.

Guzmán ha alertado de que es delicado que el nuevo juez para el caso de El Mozote esté “supeditado” al Poder Ejecutivo de Nayib Bukele. “Hay una línea de querer favorecer a estas personas, militares que están siendo procesados”, ha agregado.

 

 

Mientras tanto, VOCES reporta que el magistrado de la Corte Suprema de Justicia impuesto por el oficialismo, Óscar López Jerez, mencionó que, tras la salida del juez Guzmán, el caso El Mozote y lugares aledaños comenzará de cero.

Jerez mencionó que el problema más grande que ha tenido el juez Guzmán ha sido no pensar en el caso, sino solo en él.

“Lastimosamente el juez (Jorge Guzmán) no pensó mucho en el caso, él decidió no solicitar régimen de disponibilidad”, aseguró López Jerez.

Guzmán no quiso adecuarse a la única opción que les dejó el oficialismo y era someterse al «régimen de disponibilidad», porque, para él, el aceptar esa salida estaría avalando las irregularidades jurídicas a las que el gobierno ha estado incurriendo desde que asumió el poder, 1 de junio de 2019.

Con esto, el caso no solo retrocede los últimos cinco años en los cuales el juez Guzmán tomó las riendas del caso y buscó la verdad y hacer justicia en la masacre de El Mozote y lugares aledaños, sino también se pierden 40 años de lucha constante por parte de familiares de víctimas y víctimas de dicha masacre.
