Pronunciamiento – Bukele y los militares en la Asamblea /Statement – Bukele and militars at the Legislative Assembly

We condemn the attack against democracy perpetrated yesterday by President Bukele in his “coup attempt” against the Legislative Assembly

We, the different organizations of the social movement present here, in the face of the serious attack against democracy through the Executive’s actions against the Legislative Assembly, before national and international public opinion, express the following:

 

  1. Since the beginning of his term, President Nayib Bukele has shown an anti-dialogue, authoritarian and anti-democratic style that manifests itself in frequent violations of freedom of expression and restrictions on access to information, violations of due process and permanent confrontation with other State bodies, especially against the Legislative Assembly and the political parties represented there, especially against ARENA and – moreover – against its former FMLN party.
  2. Such an undemocratic attitude bottomed out last week. Given the refusal of the Legislature to approve a loan of $109 million whose destinations are not entirely clear or justified, Bukele illegally appealed to provisions of article 167 of the Constitution of the Republic that do not apply to this case, as the Council of Ministers can only convene the Assembly in exceptional moments and emergencies such as wars or natural disasters. The invocation to this power of the Executive is, in this case, illegal, as stated by all the instances that have made statements on this regard (FESPAD, PDDH and even FUSADES).
  3. Equally reprehensible is the call to insurrection. As expressed by former Human Rights Attorney David Morales, this right – enshrined in article 87 of our Constitution – is for the people, when rulers violate the constitutional order; and not vice versa. Bukele cannot call the insurrection; It is the people who will have to exercise this right if he continues his authoritarian, antidemocratic and violating behavior of the constitutional order of our country.
  4. And even more repudiable is militarization, violent seizure and “desecration” of the legislative precinct by President Bukele and his henchmen. The images of soldiers and police invading the blue room take us back to the dictatorial and repressive past that the president’s millennial democracy seeks to reissue. The Bukeliano “performance” included a flagrant violation of the secular character of the State: the President communicated with God, surpassing the best style of the Bolivian coup president Jeanine Añez who entered the government palace with the Bible.
  5. The actions taken by President Bukele constitute a very serious violation of institutionality, it means a rupture of the constitutional order and represents a blow against democracy. The popular organizations condemn and denounce this serious setback in national history; and we demand that this not go unpunished: that the Office of the Attorney General of the Republic investigate the crimes committed and that the Constitutional Chamber of the Supreme Court of Justice mark the constitutional limits to the President.
  6. In line with the call of various national and international organizations and institutions, we call for a dialogue between the Executive and the Legislative Assembly and the search for national agreements, not only on public security financing, but also to approve the General Water Law, deprivatize the system of retirement funds, to approve a progressive tax reform where “those who have more pay more” and other urgent issues of country in which, by the way, the Executive has not shown interest or demanded to the Assembly for its approval.
  7. We demand that President Bukele fulfill his constitutional function of seeking peace and social harmony; and not to use popular support for “coup adventures” and authoritarian drifts, but to deepen democracy and responsibly address the structural problems of the country through dialogue, allowing citizen participation, respecting institutionality and guaranteeing the rule of law.

Finally, we call on all progressive organizations, democratic sectors and the population in general to be attentive to defend democracy and demand structural transformations aimed at dismantling the neoliberal model.

Condenamos el atentado contra la democracia perpetrado ayer por el presidente Bukele en su “intento de golpe” contra la Asamblea Legislativa

 

Las diferentes concertaciones del movimiento social aquí presentes, ante el grave atentado contra la democracia que representa el ataque del Ejecutivo contra la Asamblea Legislativa, ante la opinión pública nacional e internacional, expresamos lo siguiente:

 

  1. Desde que inició su gobierno, el presidente Nayib Bukele ha mostrado un estilo anti-dialogante, autoritario y antidemocrático que se manifiesta en frecuentes atropellos a la libertad de expresión y restricciones al acceso a la información, violaciones al debido proceso y permanente confrontación con los demás órganos del Estado, especialmente contra la Asamblea Legislativa y los partidos políticos ahí representados, sobre todo contra ARENA y -más aún- contra su ex partido FMLN.

 

  1. Tal actitud antidemocrática tocó fondo la semana pasada. Ante la negativa de la Asamblea Legislativa de aprobar un préstamo de 109 millones de dólares cuyos destinos no están totalmente claros ni justificados, Bukele apeló ilegítimamente a disposiciones del artículo 167 de la Constitución de la República que no aplican a este caso, pues el Consejo de Ministros solo puede convocar a la Asamblea en momentos excepcionales y situaciones de emergencia como guerras o catástrofes naturales. La invocación a esta facultad del Ejecutivo es, en este caso, ilegal, tal como lo sostienen todas las instancias que se han pronunciado al respecto (FESPAD, PDDH y hasta FUSADES).

 

  1. Igualmente reprobable es el llamado a la insurrección. Tal como lo expresó el ex procurador de derechos Humanos David Morales, este derecho -consagrado en el artículo 87 de nuestra Carta Magna- es para el pueblo, cuando los gobernantes violentan el orden constitucional; y no al revés. Bukele no puede llamar a la insurrección; es el pueblo el que va a tener que ejercer este derecho si él continúa su comportamiento autoritario, antidemocrático y violatorio del orden constitucional del país.

 

  1. Y lo aún más repudiable es la militarización, toma violenta y “profanación” del recinto legislativo por parte del presidente Bukele y sus secuaces. Las imágenes de soldados y policías invadiendo el salón azul retraen el pasado dictatorial y represivo que la democracia milenial del Presidente busca reeditar. El “performance” Bukeliano incluyó una flagrante violación al carácter laico del Estado: el Presidente se comunicó con Dios, superando al mejor estilo de la presidenta golpista boliviana Jeanine Añez quien entró con la Biblia al palacio de gobierno.

 

  1. Lo actuado por el Presidente Bukele constituye una gravísima violación a la institucionalidad, significa una ruptura del orden constitucional y representa un golpe contra la democracia. Las organizaciones populares condenamos y denunciamos este grave retroceso en la historia nacional; y exigimos que esto no quede impune: que la Fiscalía General de la República investigue los delitos cometidos y que la Sala de lo Constitucional de la Corte Suprema de Justicia le remarque los límites constitucionales al Presidente.

 

  1. En sintonía con el llamado de diversas organizaciones e instituciones nacionales e internacionales, exhortamos al diálogo Ejecutivo- Asamblea Legislativa y a la búsqueda de acuerdos nacionales, no solo sobre financiamiento de la seguridad pública, sino también para aprobar la Ley General de Agua, desprivatizar el sistema de pensiones, aprobar una reforma fiscal progresiva donde “paguen más quienes tienen más” y otros temas urgentes de país en los que, por cierto, el Ejecutivo no ha mostrado interés ni reclamado a la Asamblea por su aprobación.

 

  1. Exigimos al presidente Bukele cumplir su función constitucional de procurar la paz y la armonía social; y no utilizar el respaldo popular para “aventuras golpistas” y derivas autoritarias, sino para profundizar la democracia y enfrentar responsablemente los problemas estructurales del país mediante el diálogo, permitiendo la participación ciudadana, respetando la institucionalidad y garantizando el Estado de derecho.

 

Finalmente, llamamos a todas las organizaciones progresistas, sectores democráticos y a la población en general a estar atenta para defender la democracia y exigir transformaciones estructurales orientadas a desmontar el modelo neoliberal.
