Mesa Frente a la Mineria Release: Assassinations in Cabanas, Dec. 22, 2009

The press release below was issued on December 22, 2009 by the National Coalition Against Mineral Mining in El Salvador.  It places responsibility on Pacific Rim mining company, for creating a context of growing tension and conflict, and the Salvadoran legal system for not punishing the perpetrators of previous crimes. PRESS RELEASE from the Mesa Nacional Frente a la Mineria Metallica

Last Sunday the 20th of December, environmentalist Ramiro Rivera Gómez, leader in the community resistance to the Canadian mining company Pacific Rim, was assassinated in the Trinidad region of Sensuntepeque, in Cabañas.  Mrs. Felícita Echeverría, next to him, died as well, and a 13-year-old girl was wounded.  According to witnesses, several hired hitmen ambushed their vehicle and shot them with high-caliber weapons, despite the presence of two police agents that were there for their safety.

This community leader, member of the Environmental Committee of Cabañas and the National Coalition Against Metallic Mining, was the victim of persecution, death threats, and assassination attempts.  The most recent of these happened on August 7 of this year, when he was shot 8 times in the back.  One of his attackers, Pacific Rim's thug, Óscar Menjívar, is now detained and his judicial hearing will be in February 2010.

With much outrage, the Christian communities and grassroots organizations of the National Coalition Against Metallic Mining comdemn this repugnant crime, and declare the following: 

1.  The death of compañero Ramiro is not an isolated case, nor is it a crime of common delinquency; it occurs in a context of threats, attacks, disappearances, torture, and assassination of opponents to the mining projects, the most emblematic of which the case of Gustavo Marcelo Rivera.  These crimes take place in the middle of a climate of growing conflict, caused by Pacific Rim, by way of buying political will, dividing communities, and promoting violent acts against anti-mining activists.

2.  The assassination of Ramiro Rivera is a result of the impunity that prevails in the zone.  Certainly the lack of justice in the disappearance, torture, and murder of Gustavo Marcelo Rivera gave incentive to the material and intellectual murderers of comapñero Ramiro.  In that sense, not only is Pacific Rim responsible for generating conflicts in communities and families, but also the police, district attorney and attorney general, and judicial system, for allowing impunity that motivates the commission of new crimes.

3.  This situation in Cabañas also reflects a certain indolence of the very President of the Republic, Maurcio Funes, who does not declare a position on these cases, despite repeated petitions by the Coalition and from the International Community.  Recently the influential U.S. Congressperson James McGovern asked that he [Funes] intervene.

The 9^th of December, community leaders from Cabañas and representatives of the Coalition arrived at the Presidential Residence to deliver a letter to Funes, which he could not receive because he had other commitments.  The communication asked, among other things, for a thorough investigation in the case of Marcelo Rivera and to apply effective security measures for all threatened environmental activists.  Probably an immediate response would have prevented the assassination of compañero Ramiro.

In light of this situation, the Coalition reiterates its demands to prosecute and penalize all those who are intellectually and materially responsible for the assassination attempts, threats, assassinations, and other crimes against the defenders of the environment in Cabañas; and to include in the list of suspects of intellectual authors of these human rights violations the mining company Pacific Rim and all its lackeys.

COMUNICADO DE PRENSA

El domingo 20 de diciembre recién pasado fue asesinado, en el cantón Trinidad de Sensuntepeque, el ambientalista Ramiro Rivera Gómez, líder de la resistencia comunitaria contra la empresa minera canadiense Pacific Rim, en Cabañas. Junto a él murió la señora Felícita Echeverría y una niña de 13 años resultó herida. Según testigos, varios sicarios emboscaron su vehículo y le dispararon con armas de grueso calibre, a pesar de la presencia de dos agentes policiales que le brindaban seguridad.

Este dirigente comunitario, miembro del Comité Ambiental de Cabañas y de la Mesa Nacional frente a la Minería Metálica, fue víctima de persecuciones, amenazas de muerte e intentos de asesinato. El último de éstos sucedió el 7 de agosto de este año, cuando recibió ocho disparos de bala por la espalda. Uno de sus agresores, el matón de Pacific Rim, Óscar Menjívar, está detenido y la audiencia judicial se realizará en febrero de 2010.

Con mucha indignación, las comunidades cristianas y organizaciones populares de la Mesa Nacional frente a la Minería Metálica condenamos este repudiable crimen, y expresamos lo siguiente:

1. La muerte del compañero Ramiro no es aislada, ni es un delito de delincuencia común; pues sucede en el contexto de amenazas, agresiones, desapariciones, torturas y asesinato de opositores a los proyectos mineros, de los cuales el caso de Gustavo Marcelo Rivera es el más emblemático. Estos crímenes se dan en medio de un clima de conflictividad creciente, causado por Pacific Rim, a través de la compra de voluntades, división de comunidades y promoción de actos violentos contra los activistas antimineros.

2. El asesinato Ramiro Rivera resulta de la impunidad que impera en la zona. Seguramente la falta de justicia en la desaparición, torturas y asesinato de Gustavo Marcelo Rivera, incentivó a los asesinos materiales e intelectuales del compañero Ramiro. En tal sentido no sólo es responsable Pacific Rim por generar conflictos en las comunidades y familias, sino también las autoridades policiales, fiscales y judiciales por permitir la impunidad que motiva a cometer nuevos crímenes.

3. Toda esta problemática en Cabañas también refleja cierta indolencia del propio Presidente de la República, Mauricio Funes, quien no se pronuncia sobre estos casos, a pesar de las reiteradas peticiones de la Mesa y de la Comunidad Internacional. Recientemente el influyente congresista estadounidense James McGovern le pidió intervenir.

El 9 de diciembre recién pasado, líderes comunitarios de Cabañas y representantes de la Mesa llegaron hasta Casa Presidencial para entregar a Funes una carta, que no pudo recibir porque tenía otros compromisos. La misiva pedía, entre otras cosas, investigar a profundidad el caso de Marcelo Rivera y aplicar medidas efectivas de seguridad para todos los ambientalistas amenazados. Probablemente una respuesta inmediata habría evitado el asesinato del compañero Ramiro.

Frente a tal situación, la Mesa reitera sus demandas de enjuiciar y castigar a todos los responsables intelectuales y materiales de los atentados, amenazas, asesinatos y demás crímenes contra los defensores del medioambiente en Cabañas; e incluir en la lista de sospechosos de autores intelectuales de estas violaciones a los derechos humanos a la empresa minera Pacific Rim y todos sus lacayos.
