A new date to discuss progress on Reconciliation Law / Discusión de la ley de reconciliación

The Constitutional Chamber of the Supreme Court of Justice (CSJ) notified the plaintiffs of the amnesty law, the resolution of unconstitutionality issued.

In a letter addressed to José Benjamín Cuellar Martínez and Pedro Antonio Martínez González, the Secretary of the Chamber states that they decided to reschedule for October 30 the oral and public hearing that would be held on March 13 to analyze compliance with the provisions ordered by the constitutional court to the Legislative Assembly and other parties after the Amnesty Law of 1993 was declared unconstitutional.

The following parties have been summoned to the court on October 30:

  • President of the Legislative Assembly
  • President of El Salvador
  • Plaintiffs in each of the accumulated processes
  • IDHUCA (Human Rights Institute of the Central America University) lawyers who were admitted as joint plaintiffs.
  • Director of IDHUCA
  • Minister of Finance
  • Attorney General of El Salvador
  • Minister of Defense
  • Ombudsman

In October 2019, José Benjamín Cuellar Martínez and Pedro Antonio Martínez González requested an extension of the deadline for the approval of the reconciliation law, which was extended until February 28, 2020.

Congresspeople approved on February 25, 2020 the Special Law of Transitional Justice, Reparation and National Reconciliation, which was vetoed on February 28 by the President, Nayib Bukele, as unconstitutional.

So far, the Legislative Assembly has not overcome the veto nor has any constitutional controversy been promoted before the Constitutional Chamber.

According to the Chamber, at the hearing, the Legislative Assembly must justify the approval of said law, while President Bukele the reason for his veto and report on the public policies he has implemented on this issue.
